Brisbane College considers legal action against Federal Government

College considers legal action against Federal Government’s student visa changes
A Brisbane-based English and business college has signalled its intention to take legal action against the Federal Department of Immigration for implementing “destructive” changes to Australia’s visa regulations which threaten the nation’s crippled international education export sector.

Kelly Colleges this week sent a letter of demand to Australian Immigration Minister Senator Chris Bowen, who recently announced changes to the Migration Regulations Act 1994 which groups different education courses under different sub-classes of student visas.

As a result, Diplomas and Advanced Diplomas registered under the Higher Education Sector Framework are being moved to a more favourable visa subclass compared with those registered under the Australian Quality Training Framework. This is despite both frameworks delivering the same tertiary level outcomes for international students.

The Australian Government’s previous spate of changes to student visa regulations last year have resulted in a 30 per cent decline in international student visa applications to date. Despite this, it receives very little proportionate support and consideration from government and has been pummelled by the Department of Immigration in a unprecedented and constant barrage of last minute policy changes which training organizations are having increasing difficulty keeping up with.

“This is not about playing politics anymore”, says Natasha Mayrseidl director, “this is now about peoples’ lives. Working Australians are losing their jobs” Kelly Colleges Director Natasha Mayrseidl said the latest round of student visa regulation
changes made it even more difficult for good students to come to Australia, essentially driving them to Canada and the United States who are welcoming this boost to their economies.

“It is deplorable what the Department of Immigration is doing to our industry and the people who depend on it for their livelihood,” she said. “As Australia’s third largest export industry, the international education sector contributes
significantly to Australia’s economy. Despite this fact, it receives very little proportionate support and consideration and has been pummelled by the Department of Immigration in a constant barrage of last minute policy changes which training organisations are having increasing difficulty keeping up with.

“The profound effect the continued drop in international students will have on other industries such as tourism and retail will be devastating and will have a domino effect across the nation.

“Kelly Colleges is only a small college but has taken the move to stand up for international education in a big way. This is definitely a case of David and Goliath. This was not a decision I came to lightly – but we need to stand up and be counted; to give Minister Bowen the message that there are better, more viable alternatives.

“Kelly Colleges employs 50 Australians who rely on the college for their livelihoods. If you multiply this amount by the number of colleges across Australia - it doesn’t take a mathematician to see that a lot of Australians will be out of jobs.”

Kelly Colleges has been training Australians and international students since it opened its doors in 1975. Most International students who study in programs at Kelly Colleges go on to study bachelor Degrees at respected Queensland universities and then use their valuable Australian degree to seek meaningful employment back in their home countries.

“These are good kids – they come here and contribute to our economy because they see a great value and benefit to an Australian education. We should be proud of this. We should be supporting this,” Ms Mayrseidl said.

“In recent years there has been a rapidly growing misconception that international students somehow take from Australians. But this is untrue. Aussies have big hearts and are very welcoming. International students contribute to our national image and enrich our cultural interactions; anyone who has ever had the positive experience of being a home stay family can relate to this. They also subsidize tuition fees for Australian students, create jobs and inject massive sums of money into the local community by their support of our tourism and retail industries.”

Australian International Education and ACPET

Many of you are involved in the delivery of education and training to international students and have been badly affected by the downturn in the industry. Understandably many of you have questions about ACPET's activities/advocacy on your
behalf for changes to current government policy settings.

Some of you will have seen in the media this week and in the media releases issued by ACPET that on Monday ACPET Chair Kay Ganley chaired the first meeting of the international Education Taskforce at Parliament House in Canberra. The Taskforce is led by ACPET and also comprises senior representatives of IEAA, EA, TDA, and the Independent Schools, as well as business representatives from a range of organisations including the Australian Chamber of Commerce and Industry (ACCI), the Business Council of Australia (BCA), the Transport & Tourism Forum, the Australian Tourism Export Council, the National Tertiary Education Union (NTEU), and the Australia India Business Council.....


.....The specific policy proposals put forward by the International Education Taskforce include the following:

Proposition 1: Consultative mechanism

The sector seeks a constructive and consultative mechanism for engagement between government ministries and the international education industry, particularly over future policy changes that have the potential to significantly affect the industry, but also to develop an effective longer term international education strategy.

Proposition 2: Key refinements to Student Visa and skilled migration requirements

The sector seeks consideration of immediate actions to address some adverse impacts of recent changes to student visa and skilled migration requirements.

Proposition 3: Promotion and marketing of Australia's education services

The sector seeks the establishment of a joint taskforce with Austrade to plan and begin to implement strategic, integrated marketing and communication campaigns to promote Australia as a preferred study destination.

Proposition 4: Immigration statistics

The sector requests that international students be removed from the net overseas migration statistics. For the duration of the student visa a student should be recorded as a student visitor. This classification should extend to their partner and child under the visa classification.

DFAT Facebook Digital Media and Communications

DFAT needs to join a digital age.

Every day a single American diplomat communicates with over a quarter of a million Indonesians using Facebook. Australia's own diplomatic service (DFAT) doesn't even use social media in Indonesia.

The latest report from the Lowy Institute, A Digital DFAT: Joining the 21st century - launched today on Twitter and YouTube - argues DFAT has a lot of catching up to do when it comes to e-diplomacy.

The report's author, Fergus Hanson, met with the heads of the e-diplomacy teams at the US, UK and Canadian foreign ministries in preparing the report. He said: 'a look at what benchmark foreign ministries are doing in this space shows how much DFAT stands to gain from adopting some of the many innovations these organisations have pioneered'.

'Increasingly DFAT is cut off from important audiences, like the blogosphere, younger people and Australians travelling to remote parts of the world', Hanson said. 'The State Department, for example, maintains nine full-time Arabic language bloggers, two Farsi bloggers and two Urdu bloggers, yet DFAT is completely absent from this space'.

In theory yes, although part of Australia's mythical self identity i.e. innovation and creativity, most prefer the status quo. In practice you would find that the personnel culture of DFAT (and other government entities e.g. DEEWR, DIAC, Austrade, Tourism Australia, state equivalents, universities and TAFE) includes perceived "neo colonial" high status and international travel opportunities, these facets would be precluded by more effective digital channels.

Already, similar roles can be carried out more effectively and economically from related Australian other language speakers both onshore and offshore within various social and business communities....

Australian Migration New Points Test 2011

Introduction of New Points Test. It is proposed that a new points test for skilled migration visa applications will be introduced on 1 July 2011. It complements the series of reforms the Australian Government announced in February 2010.

The new points test is focused on selecting highly skilled people to deliver a more responsive and targeted migration program. It was developed following a review of the current points test, which considered submissions from a variety of experts and the wider Australian community.

Ausztrália Bevándorlási Hírek Külföldi diákok. Már megint azokról írok, akik nem írnak blogot.

Tegnap este szkájpon kért tanácsot egy másik ausztrál városból egy magyar diák-házaspár. A férj már 45 fölött van, túl a korhatáron. Hiába is van kitűnő szakmája, nem felelt volna meg bevándorlásra. A felesége még fiatal, de annak nem volt jó végzettsége. Beiratkozott hát egy két éves Cer. III fokozatot adó Welfare Worker iskolába, illetve előbb egy 8 hónapos angol tanfolyamra.
Mostanában végzett. A végzés után fél éve van arra, hogy a 485-ös ideiglenes vízumra beadja a jelentkezését, de az IELTS-vizsgán az egyik tárgyból mindig hibádzik egy fél jegy, pedig már többször is nekiment. A határidő vészesen közeleg, további vizsgára már nincs idő, pályázni kellene.
Berenguel neki is mentőövet jelent. {Az esetről többször is írtam itt, tessék visszakeresni.}

Biztos, ami biztos, belenéztem a Bevándorlási Szabályzatba is. Még mindig a régi szöveg, még mindig előre követeli a nyelvvizsgát. Ezt lehet kiolvasni belőle. Egészen addig, amíg Berenguel hosszadalmas ügyének végén a legfőbb bíró másként nem olvasta, mindenki más úgy olvasta ki, hogy előre kell a nyelvvizsga. Ha megnézed a Bevándorlási Hivatal honlapján a tájékoztatót, az is azt állítja, hogy előre kell.
Gondos kereséssel rá lehet találni a Berenguel esetre a hírek között és akkor világos, hogy a tájékoztató hibás, de ha nem tudod, hogy egy brazil diák nevére kell keresned a régi hírek között, akkor magadtól rá nem jössz, az biztos!

Szóval, a házaspárnak még van egy lélegzetvételnyi ideje, még beadhatják a pályázatot. Utána persze igyekezni kell a nyelvvizsgán, mert bármikor kérheti a hivatal a tiszta 6-os eredményt.

A baj a munkával van. Kevés. A férj heti 20 órával kezdett, de mostanában csak 12 órányi munkát kap. A keresete nagy része, heti 300-320 dollár a lakbérre megy, a maradék 50-60 dollárból élnek. Fogynak. Ahogy elmesélte, egykor piknikus alkatuk volt, most meg aszkéta. Már el is felejtettem a piknikus alkat kifejezést, jó hogy eszembe juttatta.

A Welfare Worker iskola nagyon szép és nagyon jó volt, elment rá 30 ezer dollár és a végzettség az új szakma-lista szerint nem alkalmas arra, hogy közvetlenül állandó lakosira pályázzanak vele. A továbbtanulás egy Social Worker (szociális munkás) végzettségért szóba se jöhet. Nem kaphatnak további diákvízumot, mert a bankban csak 400 dollárjuk van.

Ennek a 485-ös ideiglenes lakosi pályázásnak sikerülnie kell, mert ez másfél év, teljes munkaidős munkavállalásra jogosítaná fel őket. Elmehetnének vele olyan környékre dolgozni, ahol lenne munka és talán-talán szponzor is. A helyzet kétségbeejtően sürgős és a nyelvvizsgán túl sok múlik most.

Engedélyt kértem tőle arra, hogy az esetéről név nélkül írjak erre a fórumra. Megengedte, sőt biztatott is, még érdekes részleteket is közölt, de azokat inkább nem írom meg, mert akik ismerik őket, azok rájuk ismerhetnek. Tudom, hogy többen is vannak most ilyen helyzetben, mint ők. Más városból is kapok telefonokat és szkájp-hívásokat.

Avustralya doğumlu futbolcu geçtiğimiz günlerde yaptığı açıklamada, “Türk Milli Takımı’nda oynamak istiyorum. Ay-Yıldızlı formayı giyersem, çok mutlu olurum” görüşünü belirtmişti. İstikrarlı futboluyla beğeni toplayan genç yıldızın, A Milli Takım kurmayları tarafından da tam not aldığı belirtildi. Ersan’ın Hollanda ile oynanacak hazırlık maçının kadrosuna alınacağı ve konuyla ilgili olarak yıldız futbolcudan bazı evrakların istendiği ifade edildi.

Young take on the monoculture. It is not just the deft Tony Jones and the well-chosen line-up of witty pundits and politicians that make the ABC's Q&A program such a unique and pleasurable television event.

It is the audience. Nowhere else in television, except for SBS, can viewers see Australians represented as we truly are..... In the Q&A audience are people of Indian or Chinese or Middle East background mingled in among the blond, blue-eyed Anglos, asking pointed questions in Aussie English, and simply fitting in. Watching the Q&A audience makes you realise what is lamentably lacking in the rest of the media: any effort to represent Australians in all our colour, diversity and complexity.


Business groups slam new migration test, claims English language test could exacerbate skills crisis. Business groups have slammed the Government's new skilled migration test, saying it will exacerbate the skills shortage and make it even harder for small businesses to hire new and qualified staff in specialised areas.

The comments come just after new figures from economists suggest immigration will drop over the next few years and the skills shortage will become worse as employers search for qualified staff, especially in the engineering, trades, manufacturing and construction industries.

John Hart, chief executive of Restaurant and Catering Australia, says the new test will make the skills shortage in the hospitality industry even worse, warning that restaurants and other catering firms may struggle to find qualified chefs who are specialists in overseas cooking methods.

The drought breaks. The Millennium Drought is finally over, bringing regional communities back to life. THE sunburnt country has been recharged. The ravages of drought are replaced with the kind of fruitful abundance that many feared had been lost to history. Like the Federation Drought before it, the Millennium Drought has finally broken.

Along a great inland swath from Queensland through NSW, southwestern Victoria and into South Australia, the dams and rivers are lapping at their confines. Crops are bulging in the field and nature has grasped the opportunity to restock and recover from the decade-long dry.


House prices hit a wall. Australia’s house price growth slowed to a crawl in the three months to September, amid higher interest rates and worsening affordability.


Tom predicts a riot. Last week, I listened to Gapyear.com founder Tom Griffiths talking about supply conditions from the UK and Europe. He said: “Let’s have a look some news from Europe on what’s been happening this year....

..If this unprecedented negative view of Australia won’t affect future numbers, let’s all carry on as normal. But if there’s a chance there might be a problem, we should address it. And no-one seems to remember the solutions Tom offered – chiefly working with operators like himself in the UK and Europe to spread the word that there are jobs in Australia.

This morning he wrote me an e-mail pointing out how Australia is a positive solution for many UK students and suggesting the industry works together to come up with one message – “that Oz is the perfect place to come to escape all this, further your life, work and travel”.

Nem érinti továbbá azokat a nagylelkű átmeneti intézkedéseket sem, amiket az egykori külföldi diákok számára léptettek életbe.

The Minister for Immigration and Citizenship, Chris Bowen, today announced a new points test to assess independent skilled migrants as part of the Gillard Government's ongoing commitment to reforming the skilled migration program to deliver the skills Australia needs.

Mr Bowen said the new points test will emphasise the importance of English, work experience and high level qualifications, and is designed to ensure no one factor guarantees migration. These changes to the points test are an important next step in the series of reforms to the skilled migration program announced by the Government in February this year, Mr Bowen said. The new points test is proposed to take effect from 1 July 2011, subject to passage of supporting legislation through the Parliament. It will apply to anyone lodging an application from 1 July 2011.

The new test will have a mixed impact: some prospective migrants will do better under the new test, while others will do worse. Past revisions to the test have resulted in a spike in applications as some people seek to bring forward their application if they feel they may be disadvantaged by the new test. The Government will closely monitor application patterns in the coming weeks and months, and will take corrective action as necessary should a spike occur.

There are some significant changes:

- Under the existing points test, points are awarded on the basis of an applicant's occupation. Under the new points test points will no longer be awarded on the basis of occupation. Applicants will still be required to nominate a skilled occupation and provide a satisfactory skills assessment from the relevant Australian assessment authority for that occupation. The equal weighting of occupations will have the added benefit of not distorting the study choices of international students.

- The new test will give greater weight to higher level qualifications as part of its focus on human capital. Under the current test, points are not awarded for overseas qualifications - regardless of the quality or level of the qualification.

Under the new test, approved and recognised overseas qualifications will be treated as equivalent to Australian qualifications. In recognition of the additional benefit that study in Australia brings, applicants who have studied in Australia will receive five points towards the new pass mark of 65 points. People who have studied in regional areas will receive an additional five points.

- Another change goes to the treatment of the age of applicants. The philosophy in the old points system of placing a premium on youth was developed many years ago and is still valid today. Younger migrants can help offset Australia's ageing population and boost participation rates. The new test, however, also recognises the contribution made by people of different ages, and takes into account how age interacts with qualifications and work experience factors. The new points test proposes two important changes regarding age. Firstly, the maximum points available for age will now accrue to those between 25 and 32 years, compared with 18 to 29 years in the current test. This age range is most likely to maximise lifetime earnings, and recognises that it is often difficult to assess the full potential of someone who has had little time to prove themselves in the workforce. It is also consistent with the average age of employer sponsored migrants. The second, and related, change is that the age threshold will be extended from 45 to 49 years in recognition that slightly older and highly talented specialists still have much to offer.

- Under the old test points were given for IELTS 6.0 with maximum points given for

IELTS 7.0. Under the new test no points will be given for IELTS 6.0, 10 points will be given for IELTS 7.0 and 20 points will be given for IELTS 8.0.

English Australia member colleges will also be interested to note the following in Minister Bowen's speech:

"I'm a strong supporter of the efforts of Australian universities and institutions to attract foreign students. It is not only good for the budget bottom line of the higher education sector, it is an important part of Australia's international engagement. For example, educating the future leaders of our regional partners can make an important contribution to our diplomatic efforts long into the future. The Minister for Higher Education, Senator Evans, and I will be having more to say about the interaction of our higher education and immigration policies in the not too distant future."

Student expo reveals China crisis. "WHERE is the Australian section?" we asked at one of the smartly branded, well-attended British stands.

"Oh, it's tucked down in the back corner." Sure enough, there were 19 Study in Australia-branded booths, but unlike the buzzing aisles of the British, American and Canadian sections many of the Australian marketers were left talking to each other.

Welcome to China's biggest international student mart, the China Annual Conference for International Education. It's one of two held each year (the other is in March) that tour China's six biggest cities to provide information on offshore universities, colleges and schools to the 170,000 or so students who will leave to study overseas next year. But, increasingly, Australia is not on the shopping list....

...Projected numbers from China, representing nearly 30 per cent of all international students, look like falling and falling fast. Monash has estimated an 8 per cent to 11 per cent fall in enrolments next year but education agents in China, who recruit upwards of 90 per cent of all non-thesis-based places, are estimating a fall in demand of anywhere between 10 per cent and 40 per cent for universities and even higher for vocational and English-language colleges.


Disagree, maybe not in China, but many education fairs you will find more institutional personnel and agents than genuine prospective students, why?

Five, ten, fifteen years ago physical promotional channels were the only alternative through brochures, post, fax and offshore international education events to which personnel would travel then try sell, spruik or promote courses and institutions hopefully leading to applications, then students enrolling onshore.

However, post internet digital, virtual or online marketing has come to the fore, all year round for economic cost, facilitating the most effective "marketing" channels i.e. satisfied students onshore, alumni, family and agents, who could make up 99% of all enrolled students (applications do not equate to actual commencements).

Why do institutions still persist with education fairs and related events? Travel rorting or opportunities, and Austrade complicit in preferring one off events with simplistic evaluation (and possibly bonuses tied in to numbers of Australian institutions, not actual enrolments a year later?)..... as several university personnel stated several years ago, "if we used the internet for marketing, which we acknowledge as effective and economic, we would not need to travel!" or "why do we need a virtual marketing strategy, we have approved travel plans?"

Effective marketing would include (virtual or digital) marketing strategy, regular feedback from existing students, using online media for promotions, using websites as "shopfronts" linked to offshore agents, then dealing with direct enquiries all year round in cooperation with agents.

Enrolments and marketing are not simply one off selling of applications, but a process of up to one year or more from original enquiry through study application, visa application process, travel, enrolment, census, satisfied student, graduation and then "word of mouth".

Benefits of International Students and Education for Australia

International students: in our best interests. International education is the third-largest earner of international export revenue for Australia, generating more than $12 billion per annum, trailing only the coal and iron ore extraction industries, and eclipsing tourism.

Australia’s share of the international education market is many times larger than would be expected for a country that produces only 1.2 per cent of the world’s GDP. Curiously, however, instead of being a case for great national pride, it’s not universally appreciated.

Education is a high value-add service industry that leverages Australia’s intellectual resources. Australia outperforms many of its peers, enrolling more than 7 per cent of the world's international students, despite having less than 1 per cent of the world's population. However, the influx of international students into our universities is not perceived across the community as an unqualified good. Why is this outstanding success story not always applauded?

The benefits of inbound international students into our universities are easy to identify. To start with, international university education generates well-paid employment for highly qualified people in Australia.

Second, the benefits of inbound international education spill over into other sectors of the economy.

Third, international students foster long-term goodwill and international understanding between Australia and the countries from which students originate.

Fourth, higher education has all the attributes of a luxury product, where brand equity associated with university names carries substantial prestige and opportunities for premium pricing.

Finally, almost all of the economic benefits are retained in Australia and reinvested in our education and research capability....

Interesting why industry leaders only now after 20 years are trying to persuade Australians of the benefits? Till now the industry, especially TAFE and universities, have been avoiding scrutiny of their international activities for good reason i.e. failed offshore ventures, rorting of travel under the guise of marketing, lack of marketing strategy e.g. evaluating student experience and welfare etc.

One major point the writer does not make is that demographics i.e. ageing populations in western world requires higher levels of state resources to be directed to health and pensions, but without raising taxes, which will be compounded further by "baby boomers" starting to retire.....

Further, coincides with media, politicians and anti immigration or neo white Australia protagonists stirring up negative sentiment amongst Australians suggesting we are being invaded from the north....

If all international students were from Europe, Britain and North America it would probably not even be an issue.....

However, with new enrolments or commencements plummeting it will mean over the next few years higher domestic fees for TAFE and university, job losses, less tourism etc. but on the plus side property prices will stagnate and may decline, as appears to be happening in Melbourne right now.

Australian Education Industry International Marketing Issues

Government scrambles to avoid China crisis. THE marketing of tertiary education to international students by Austrade has had a few "teething issues" in the midst of the growing crisis in the $18.6bn industry.

This will get the attention of Tertiary Education Minister Chris Evans.

But he claimed that long visa processing times, which plagued the sector, had been largely resolved. However, the government's response and understanding of the impending crisis in student numbers appears fractured, with three departments now having some responsibility for the issues: tertiary education, immigration and trade, which was handed responsibility for marketing international education in July....

...But at the recent China International Students Conference fair, which began a six-month tour in Beijing two weeks ago, there were fewer Australian institutions represented (18) than from New Zealand. By comparison Canada, which is doubling its student intake during the next two years, had 80 booths.


Education fairs are the most expensive sales or promotional channel and should be avoided in favour of effective "marketing" channels i.e. word of mouth via students onshore/offshore, agents and internet which account for 99%+ of all students.

Unfortunately Austrade revenue model, yes they charge for their services, (and possibly personnel bonus scheme?) , favours one off physical promotional events hosting Australian visitors, versus sustainable long term offshore marketing strategy....which is left to offshore agents.....

Australian Education Minister Supports Overseas Students

Feds back overseas students. TERTIARY Education Minister Chris Evans last week stressed he wanted debate over international education kept separate from that on population.

During the election campaign in August, Opposition Leader Tony Abbott attracted headlines with a warning that overseas student numbers had to be "politically sustainable".

Similarly, the government won popular support for its student visa crackdown, while acknowledging lower numbers would hurt the economy.

However, in a speech at the University of Canberra last week, Senator Evans, the former immigration minister, said student visas were temporary. "They are not included in permanent migration program numbers and we remain committed to maintaining our international student program as an uncapped program," he said.

In a world where competition for human capital was fierce, international education was one of the most important economic reform areas, Senator Evans said....


....but don't let that get in the way of Australian politicians, media and society playing the race card..... "wagging the dog", "dog whistling" now "dogs chasing their tails" wondering why students are not coming to Australia...

Birleşmiş Milletler (BM) Kalkınma Programı, yeni İnsani Gelişme Endeksi’ni (İGE) açıkladı. Buna göre, dünyada yaşanacak en iyi ülkeler sıralamasında Türkiye 83. sırada yer aldı.

Listede ülkeler, çok yüksek, yüksek, orta ve düşük insani gelişmenin görüldüğü gruplar şeklinde ayrıldı. Eğitim, sağlık, gelirler ve mekroekonomik değerler sıralamada belirleyici unsurlar oldu. BM’nin raporunda Norveç 169 ülke arasında birinci sıraya yerleşti. Avustralya ikinci, Yeni Zelanda üçüncü ülke oldu. Nijer, Demokratik Kongo Cumhuriyeti ve Zimbabve son üçte yer aldı.
